On 9 April 2021, ICASA (Independent Communications Authority of South Africa) published its Code for Persons with Disabilities to be adhered to by Electronic Communications Service licensees and Television Broadcasting licensees. The Code aims to ensure that persons with disabilities have access to electronic communications and television broadcasting services.
The Code compels broadcasting service licensees to implement audio description, including sign language, subtitles, and closed captions in video displays. However, it does not mandate the provisioning of open captions that are permanently embedded in the video display. By failing to mandate the provisioning of open captions, the Code falls short of ensuring that deaf and hearing-impaired persons enjoy equal access to broadcasting services.
